Defensive and Evasive Driving Training Agreement

ESL Defensive and Evasive Driving Training Agreement:

In consideration for being permitted to participate in defensive, evasive, security, emergency, or performance driving exercises and related vehicle training (collectively, the “Training”), I understand and agree as follows:

1. ASSUMPTION OF RISK.
I understand that the Training may involve vehicle acceleration, braking, steering, reversing, backing, emergency maneuvers, skid or traction-loss exercises, obstacle avoidance, confined-course operations, multiple vehicles, passengers, mechanical failure, surface hazards, weather, and other conditions that can cause collisions, rollover, loss of control, property damage, serious bodily injury, permanent disability, or death. I knowingly and voluntarily assume the risks inherent in these activities and the ordinary risks associated with participating in the Training.

2. SAFETY RESPONSIBILITY.
I will inspect the vehicle and training area to the extent reasonably possible, use required restraints and safety equipment, follow all speed limits, course rules, and instructor directions, immediately report unsafe conditions or vehicle problems, and stop participating if I believe continued participation is unsafe.

3. RELEASE AND WAIVER.
To the fullest extent permitted by applicable law, I release and waive claims against Executive Support & Logistics, Inc.; its officers, directors, employees, instructors, contractors, agents, affiliates, clients, successors and assigns; and the owners, operators, lessors, sponsors, and personnel of any premises, track, training area, vehicle, or equipment used for the Training (collectively, the “Releasees”) for injury, death, loss, or property damage arising from my participation in the Training, including claims based on the ordinary negligence of a Releasee. This release does not apply to liability that cannot lawfully be waived.

4. INDEMNIFICATION.
To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Releasees from third-party claims, losses, liabilities, or costs arising from my negligent, reckless, or intentional acts or my violation of safety rules or instructor directions.

5. DRIVING FITNESS AND IMPAIRMENT.
I represent that I am legally and physically able to operate a motor vehicle as required for the Training, or I will disclose any relevant restriction before participating. I will not drive while impaired by alcohol, illegal drugs, cannabis, medication, fatigue, illness, or another condition that may impair judgment, reaction time, coordination, or safe vehicle operation.

6. EMERGENCY CARE.
If I am injured or become ill and cannot provide instructions, I authorize reasonable emergency first aid and medical response. I understand that I remain responsible for medical costs not otherwise covered.

7. SEVERABILITY.
If any portion of this Agreement is held invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

8. SAFETY RULES

Participants are responsible for their actions and will not begin or perform an exercise unless directed by an instructor.

Anyone who appears impaired by alcohol, drugs, cannabis, medication, fatigue, illness, or another condition that may affect safe driving will not be permitted to participate.

A required liability waiver and this safety acknowledgment must be completed before practical driving exercises.

Seat belts or approved restraint systems must be worn whenever the vehicle is moving unless an instructor specifically directs otherwise for a controlled exercise.

Non-training vehicles must remain in the designated parking area. Participants who are not in a training vehicle must remain in the designated observation area unless directed otherwise.

Do not enter or leave the active training area without instructor authorization.

Unless otherwise directed, vehicle keys will be removed from the ignition and placed at the instructor-designated location whenever the driver seat is unoccupied.

Loose items are prohibited inside training vehicles. Only instructor-approved equipment may remain in the passenger compartment, and water bottles or similar items must be secured.

No handheld phone use is permitted while operating a training vehicle. Radios and other communications equipment may be used only as directed.

Strictly follow all exercise instructions, traffic patterns, cones, staging procedures, and speed limitations. Unsafe speed or failure to follow instructions may result in immediate removal from the exercise or course.

Reduce speed safely and promptly after completing an exercise and before entering staging, observation, parking, or administrative areas.

Administrative vehicle movement will not exceed 15 mph unless the instructor establishes a different limit for the specific facility.

Enter and exit training vehicles only in designated or instructor-approved areas. Do not approach a moving vehicle unless specifically directed.

If radio or instructor communication is lost, safely stop or hold position, activate hazard lights when appropriate, and await further direction.

Emergency stop signal: “STOP, STOP, STOP.” When this is broadcast or shouted, drivers must safely stop immediately and remain stopped. Participants in observation or staging areas must remain in place and await instructions.

Immediately report any collision, contact, mechanical concern, warning light, fluid leak, tire issue, injury, illness, or unsafe condition to an instructor.

Facility, client, vehicle-provider, or instructor rules may be more restrictive than these rules. The most restrictive applicable safety requirement controls.
